ALL CREATURES PET LODGE CONTRACT
This is a contract between All Creatures Pet Lodge Inc.
(hereinafter called “Kennel”) and the pet owner whose
signature appears below (hereinafter called “Owner”)
- Owner agrees to pay the rate for boarding,
and or day care, and or grooming in effect on the date pet is checked
into Kennel.
- Owner agrees to pay all costs and charges
for special services requested, all veterinary costs for pet during
the time said pet is in the care of the Kennel, and all fees incurred
by Owner through Owner’s failure to comply with the Kennel’s
Cancellation Policy. We reserve the right to bathe and dip any animal
at the owners expense
- Owner further agrees that the pet shall not
leave the Kennel until all charges are paid to Kennel by Owner.
- By signing this contract or submitting a booking
form and leaving a pet with Kennel, Owner certifies to the accuracy
of all information given about Owner and said pet on this contract,
or booking form.
- Kennel shall exercise reasonable care for
Owner’s pet while Owner’s pet is in the Kennels custody.
The Owner recognizes the potential risks involved with group play,
dog day care, boarding, and grooming due to the unpredictable nature
of dogs.
- It is expressly agreed by Owner and Kennel
that Kennels liability shall in no event exceed the lesser of the
current chattel value of a pet of the sale species or the sum of
two hundred dollars per animal boarded. The Owner further agrees
to be solely responsible for any and all acts or behavior of said
pet while it is in the care of Kennel.
- Owner specifically represents that he or she
is the sole Owner of the pet, free and clear of all liens and encumbrances.
- Owner specifically represents to Kennel that
the pet has not been exposed to any illnesses requiring vaccinations
for boarding within a thirty-day period prior to boarding, day care
or grooming. Also, it is recommended that all inoculations be administered
at least 20 days prior to check in to insure proper immune system
stabilization. Standard immunization effective rates are not known
to be 100%, furthermore it is assumed that all inoculations are
injected and not administered intranasal, thus allowing for a better
effective immunization. Any questions regarding vaccination and
applications should be directed to your animals Veterinarian.
- All charges incurred by Owner shall be payable
upon pick up of pet, or when billed to Owner by Kennel listed on
contract. The Kennel shall have and is hereby granted, a lien on
the pet for any and all unpaid charges resulting from services rendered
to pet while at the Kennel. The Owner hereby agrees that in the
event the charges are not paid when due in accordance with this
contract, the Kennel may exercise its lien rights upon ten days
written notice given by Kennel to Owner by certified mail to address
shown on contract. Kennel may dispose of pet for any and all unpaid
charges, at private or public sale, in the sole discretion of the
Kennel for the difference. All monies realized by Kennel at such
sale, over and above the charges due and costs of sale, shall be
paid by Kennel to Owner.
- Owner agrees that the Kennel may collect amounts
owed by Owner due to Owners failure to comply with the Kennels cancellation
policy by charging such amounts to Owners credit card (data concerning
which Owner has supplied to the Kennel).
- Owner represents to the Kennel that all credit
card information Owner has provided to the Kennel is accurate. Owner
further represents that all information Owner has provided to the
Kennel about Owner is accurate, and that Owner is over 21 years
of age.
- If pet becomes ill or if the state of the
animal’s health otherwise requires professional attention,
the Kennel, it its sole discretion, may engage the services of a
veterinarian, administer medicine, or give other requisite attention
to the animal. The expenses and liabilities thereof shall be paid
by the Owner.
- Owner assumes any and all expenses or liability
for injuries that Owners pet may inflict upon any human or other
pet while in the Kennel. Owner agrees to indemnify and holds the
Kennel and its employees harmless from any and all expenses and
liability incurred as a result of injuries Owners pet inflicts upon
any human or other pet while in the Kennel.
- Kennel reserves the right to change the level
or type of daycare/boarding or secure a pet as necessary, if in
its sole discretion it is believed necessary to ensure the safety
of the pet, other dogs or its employees.
- Owner hereby grants the Kennel the right to
take photographs of Owner’s pet while the Kennel is caring
for Owner’s pet, and to post or reproduce any and all photographs
taken (as well as Owner’s pet’s name) on or in, without
limitation, the Kennel’s web site, promotional materials and
merchandise, without becoming liable to the Owner (or the Owner’s
pet) for any royalty payment of any kind. OWNER HEREBY RELEASES,
COVENANTS NOT TO SUE, AND FOREVER DISCHARGES THE KENNEL OF AND FROM
ANY AND ALL CLAIMS, DEMANDS, RIGHTS, AND CAUSES OF ACTION OF WHATEVER
KINDOR NATURE INCLUDING, BUT NOT LIMITED TO, APPROPRIATION OF THE
PICTURE OR NAME OF OWNER’S PET FOR COMMERCIAL ADVANTAGE, PUBLICATION
OF FACTS PLACING THE OWNER AND/OR OWNER’S PET IN A FALSE LIGHT,
AND PUBLIC DISCLOSURE OF PRIVATE FACTS ABOUT THE OWNER AND/OR OWNER’S
PET, ARISING OUT OF OR RELATING TO ANY PHOTOGRAPHING OF OR USE OF
PHOTOGRAPHS OF OWNER’S PET PURSUANT TO THE AUTHORITY OWNER
HAS GRANTED THE KENNEL IN THE SENTENCE IMMEDIATELY PRECEDING THIS
SENTENCE.
- This contract contains the entire agreement
between the parties. All terms and conditions of this contract shall
be binding on the heirs, administrators, personal representatives,
and assigns of the Owner and the Kennel.
- Any controversy arising out of this agreement
shall be submitted to binding arbitration by a single arbitrator
selected by the American Arbitration Association. Such arbitration
shall be binding, and any judgment granted by the arbitrator may
be entered in any court of proper jurisdiction. The venue for such
arbitration shall be Seminole County, Florida.
- Sunday pickups are by appointment only and
you are charged as if your pet was picked up on the next day (Monday).
- Contract Period: Signing contract binds Owners to contract terms for any and all "FUTURE" services, provided by All Creatures Pet Lodge to any and all (Pets) belonging to signing Owner.
